The working agreement between you and BIE.

1. Who these terms apply to
These terms govern your use of the Behavioral Intelligence Engine platform, the BIE API, the BIE MCP server, and any intelligence output the platform produces (collectively, the “Service”). They apply to any account created at bieintel.com, to any API key issued from such an account, and to any individual acting on behalf of an organisation holding such an account.
2. Account registration
You must provide accurate account information and keep it up to date. You are responsible for all activity under your account, including the activity of any team members you invite. Keep your credentials — password, API keys, OAuth session — reasonably secure. If a credential leaks, revoke it from Settings and notify security@bieintel.com.
3. The service we provide
We ingest data from the sources you authorise, classify it using the BIE engine, and produce intelligence output (reports, digests, agent drafts, API responses). We will operate the Service with reasonable skill and care. During this early phase we do not commit to a specific uptime percentage — the platform status page is the live reference for operational health. We will treat the behavioural data you entrust to us in accordance with the Privacy Policy and the Security page.
The Service is a decision-support tool. Intelligence output is derived from behavioural signals and is probabilistic. You are responsible for deciding what, if anything, to do with any given report, recommendation or agent draft.
4. Acceptable use
You agree that you will:
— only connect platforms and data you are entitled to connect;
— only use the Service for lawful purposes and in a manner consistent with the platform terms of each connected source;
— not use the engine to target individuals in a way that would be unlawful in the jurisdictions you operate in — including unlawful surveillance, discrimination, or profiling of protected characteristics;
— not attempt to reverse engineer the engine, extract training state, or circumvent rate limits, plan gates or abuse detection;
— not resell the raw Service to third parties without a written reseller agreement.
5. Data ownership
You retain ownership of the data you submit to the Service (“Customer Data”). You grant us a limited, non-exclusive licence to process Customer Data solely to provide the Service and improve its underlying models — provided that no Customer Data is used to train models for the benefit of another customer. We own the Service, the BIE engine, and all intelligence output templates and infrastructure — you receive the intelligence output produced for your organisation, not the engine itself.
6. Paid plans, billing, and cancellation
Paid plans are billed through Stripe. Plan limits and pricing are listed on the pricing page. Plans renew automatically until cancelled. You can cancel from Settings or by writing to support; cancellation takes effect at the end of the current billing period. No refunds are issued for unused time unless we agree otherwise in writing, except where required by law.
We may change plan pricing with at least 30 days’ notice before the next renewal. If you do not agree to a price change you may cancel before the renewal without penalty.
7. API and BYOK usage
API keys issued from your account are bound to your plan and its per-minute / per-day quotas. Exceeding quotas returns an HTTP 429 with a Retry-After header. Sustained abuse or anomalous usage may result in temporary key suspension — we will notify the account holder before or as soon as practicable after suspension.
8. Confidentiality
Each party will treat the other’s non-public information as confidential and use it only to perform under these terms. Confidential Information does not include information that is public, was already known without restriction, or is developed independently without reference to the other party’s data.
9. Warranty disclaimer
The Service is provided “as is” and, to the maximum extent permitted by law, we disclaim all warranties — express, implied or statutory — including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or produce any specific result.
10. Liability
To the maximum extent permitted by law, neither party’s aggregate liability arising out of or relating to these terms will exceed the amount paid by the customer to BIE in the twelve months preceding the event giving rise to the claim. Neither party will be liable for indirect, incidental, consequential, special or punitive damages, or for loss of profits, revenue, or data. Nothing in this clause limits liability that cannot be limited under applicable law (including for fraud, death or personal injury caused by negligence, or breach of statutory duty).
11. Indemnity
You will defend and indemnify us against any third-party claim arising from your violation of clause 4 (Acceptable use) or your Customer Data infringing a third party’s rights. We will defend and indemnify you against any third-party claim that the Service, as provided, infringes that third party’s intellectual-property rights.
12. Termination
Either party may end the agreement for any reason by cancelling the subscription or by 30 days’ written notice. We may suspend or end the Service immediately for an account that is being used in a way that harms the platform, other customers, or the public — we will give you a written reason and, where practical, a chance to correct course first. On termination, your access to the Service ends, and your data is handled per the Privacy Policy.
13. Governing law
These terms are governed by English law. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales, except that we may seek injunctive relief in any jurisdiction where our rights are threatened. If you are a consumer resident in the EU, you retain the benefit of the mandatory consumer protections of your country of residence.
14. Changes to these terms
We will update this page when the terms change. Material changes are announced by email to the account holder before they take effect. The “Last updated” date above reflects the most recent revision.
